Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
Parties and Scope
These are the terms and conditions (“Terms”) that govern the relationship between you, our customer (referred to as “you” in these terms) and BROADHILL International Limited Company No.RC1427184 of 2, Pade Odanye Street, Adeniyi Jones, Ikeja, Lagos. The Terms are subject to change without prior notice, except that the Terms in force at the time you place or modify an order will govern the order in question.
Visapoint.travel is primarily an advisory and consulting service, one designed to guide you in securing visa issuance on applications, we may also assist in providing travel support documents such as but not limited to hotel bookings, flight bookings, tour bookings, travel insurance and templates where necessary within our limits. Our Core responsibility includes but not limited to helping in Identifying, recommending, vetting and providing (where applicable) documentation(s) required for either a Visa application or onward journey of existing Visa holder(s). This also includes the completion and submission of application forms to appropriate High Commissions, Embassies and application centre as the case may be.
Our role is to recommend, advice, amend and support in the completion of the application forms on the condition that you have HONESTLY provided all required information, supporting documentation and travel itinerary enough to enable us do our job.
Our Role is to simply to advice and amend any errors before submitting your application to the consulate, embassies, high commissions, appropriate collection bodies or issuance authorities. After you place an order, you will receive an e-mail from us acknowledging that we have received your order. If your order appears to be correct, we will provide you with your application login details to upload all the required visa application documentation.
These Terms apply to any offer and any agreement between you and Visapoint.travel and to the provision of any service provided to you by or on behalf of Visapoint.travel in respect of but not limited to the processing of visas and/or documents for you or on your behalf. Some Terms may refer to an issuing authority, which is the body being an embassy, consulate, airline or other agency that issue or supply the documents requested by you.
If Visapoint.travel provides you with a translation of the English language version of these Terms, you agree that the translation is provided for your convenience only and that the English language versions of these Terms will govern your relationship with Visapoint.travel. If there is any inconsistency between the English language version of these Terms and the translation, the English language version shall take precedence.
Procedure
Visapoint.travel will endeavour to provide you with accurate information and to ensure that you obtain the visa for your trip for the date required in a timely manner. Nevertheless, you should remember that all requirements to obtain the visa (documentation, fees, time frames, etc.) are calculated based on general criteria and can vary according to information provided by you such as current or previous nationality, residence, gender, age, profession, recent travel, religion etc. You should also note that the issuing authority may change general country requirements without notice or require additional specific information from you. Visapoint.travel will try to inform you as soon as practicable of such changes.
Submission of documentation
Visapoint.travel will only process the application(s) indicated in your request; it assumes no responsibility for other visas required for your trip that have not been requested or which relate to stops on your trip. However, Visapoint.travel may advice on the necessary visas required for the concerned trip.
By submitting request(s) to review and package visas application(s) to Visapoint.travel, the applicants is deemed to have accepted these terms. Once you have successfully purchased a visa consulting service with visapoint.travel, you would receive an e-mail containing:
- Your Selected Visa Consulting Service(s) (Visa Type, Destination e.t.c)
- A copy of the Visa requirement for your selected Visa category.
- An order confirmation Code (required for completing an application form and uploading supporting documents.
- A web link to the Application portal where an application forms can be completed or uploaded.
Phone orders will be accepted on the day of placement and mail orders will be accepted provided we are furnished with the applicants name, phone number, email address, nationality, and number of visas, visa destination and visa category.
Visapoint.travel.travel reserves the right to refuse in its total discretion to handle any application at any time and no reason need be given.
Obtaining your travel documentation
Visapoint.travel will send your visa application documents to you prior to submission at the designated embassy/consulate/High commission/Data collection centre. When Visapoint.travel sends travel documents to you, it is important that you confirm that all the documents you need for your visa application have been enclosed in your application kit; that all required information has been correctly inputted for your selected visa category. You must notify Visapoint.travel within 24hrs of receipt of your application kit via email/ Phone if you identify any discrepancy in your documentation.
Please note that the right to issue or deny a visa application is the exclusive responsibility of the issuing authority and immigration officials in selected country. Also the final decision to admit entry into the country or region, even when all of the stipulated requirements have been met resides exclusively with the countries immigration and Entry clearance officials. Visapoint.travel does not guarantee that the issuing authority will issue the required visa, in a timely manner and within the specified period requested.
The fees payed to visapoint.travel is for reviewing and completing applications other application related value added services only. Customers are advised not make any non-refundable fares or reservations payments until visas have been obtained.
Additional services
Visapoint.travel may offer to provide additional service in some jurisdictions e.g. Concierge Service, Digital Photo Service, Pre-check Service, Packaged Tours, Flight ticketing , Hotel Bookings . The description and relevant terms for those Value added services would be communicated to customer depending on their unique circumstance.
Fees
The fees for Visapoint.travel services shall be those specified on the website, including any indirect taxes (if any) that are applicable to the fees ,and other charges or any courier or delivery service, all of which must be paid by you.
Visapoint.travel consulting fees are non-refundable.
Consular fees and availability of services are subject to change without notice. Fees and services may differ between the time the order is placed and when the ordered is completed. Visapoint.travel will endeavour to communicate said changes to the client where possible. Visapoint.travel reserves the right to select the most appropriate service available given the time constraints as indicated by the client.
In the event that a visa application is submitted on your behalf and the request is rejected for any reason, Visapoint.travel will, at your request, make an additional attempt to secure the travel documentation required for another application. You will be required to pay any additional fees required by the issuing authority and if the additional attempt is needed due to an error made by the client on a visa application Visapoint.travel may add additional charges.
Orders which are not submitted via the online order process may be charged an additional administrative fee if so specified on the Website. Visapoint.travel service fees may vary according to the number of business processing days available to procure the service. Consulate closings and holidays are excluded.
Once the application has been submitted to the appropriate government agency full fees will apply. Additional cancellation fees may be applied for early withdrawal of the application.
Warnings / Disclaimers
The issuing authority will make the final determination as to the type of visa, number of entries, processing time and for what duration it will be issued. Prior to approval, the issuing authority may ask for additional documentation. The issuing authority may reject any visa, passport or other travel document application for any reason and may not provide a reason to you/Visapoint.travel for the rejection. Visapoint.travel does not issue visas and cannot make any guarantee or assurances that any issuing authority will issue any document nor can Visapoint.travel guarantee the time required for an issuing authority to grant or reject an application. Issuing authorities may choose to grant a different type of travel document than that which the applicant has requested which may impact the purpose, validity or number of entries. As a result, non-refundable tickets or reservations should not be purchased until all the required travel documents for your trip have been secured. Visapoint.travel, in addition to the issuing authorities, reserves the right to prioritize processing according to the travel dates you provide. Visapoint.travel service fees are assessed for taking reasonable actions to foster the issuance of a requested travel documents.
Visapoint.travel will use its best endeavours to process applications for visas and/or documents at the client's request. However, Visapoint.travel shall not be held responsible for nor accept any liability for the actions of any consulate, embassy in delaying or not issuing such applications for any reason whatsoever, nor shall Visapoint.travel be held responsible for expense and/or delay arising from or in connection with:
- Incomplete application forms or
- Incorrectly or falsely completed application forms or
- Inaccurate or incomplete supporting documentation. Any expense or cost incurred by the client due to these delays or non-issuances shall not be the responsibility of, nor shall any charges be levied upon, Visapoint.travel.
Visapoint.travel will attempt to assist the traveller in procuring the relevant documents to meet the client’s desired travel plans, however in any event, travel plans should not be confirmed until the traveller has secured the necessary documents to allow entry.
Visapoint.travel provides visa and passport information in good faith on the express understanding that the said information is the interpretation of any or all information provided by respective embassies, consulates at any or all times and Visapoint.travel shall not accept responsibility or liability whatsoever for any errors and/or omissions in the information.
Visapoint.travel will endeavour, wherever possible, to process the client's visa, and/or document based on the instructions given and information provided, although it is the client's express responsibility to ensure that the validity of the said visa obtained includes and covers the periods of time in which the client plans to enter and leave the country or countries that the client is visiting and for the number of entries to that country and is valid for the purpose intended.
When the embassy/consulate/High commission returns your passport and documents, it is your responsibility to verify that all the visas you require for your trip have been obtained, that the visas for each country you intend to visit are valid for the entry and exit dates of your visit, that your personal details are reflected accurately, and that your passport is valid for at least six months beyond the completion of your trip. Please note that even when a visa is issued, a traveller may be denied entry since in each country the local immigration officials make the final entry decision. Visapoint.travel recommends all travellers secure a visa prior to departure and do not attempt to obtain one “on arrival”.
Liability
All proprietary rights in information received by Visapoint.travel shall remain the property of Visapoint.travel All forms of communication between public viewers and Visapoint.travel including but not limited to written, spoken or electronic (email) correspondence may be recorded to enable Visapoint.travel to carry out its regulatory responsibilities.
The client agrees that use of the service is entirely at client's own risk. Services are provided without warranty of any kind, either express or implied, including without limitation any warranty for information, services, advice, uninterrupted access, or services provided through or in connection with the service, including without limitation the processing of visas and the results obtained through the service. You acknowledge that you have exercised your own skill and knowledge in determining whether the service provided under this specific agreement meet your specific requirements and you have not relied on any statements or representations made by Visapoint.travel or its employees, agents, affiliates, content providers, or related companies.
This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behaviour, negligence, or under any other cause of action.
The client specifically acknowledges the service is not liable for the defamatory, offensive or illegal conduct of other clients or third parties and that the risk of injury from the foregoing rests entirely with client.
Neither Visapoint.travel nor any of its employees, agents, affiliates, content providers, or related companies (indemnified persons) shall be liable for any direct, indirect, incidental, special or consequential damages or costs (including legal costs) arising out of use of the service or inability to gain access to or use the service in full or in part. To the extent that liability cannot be excluded due to reasons of negligence or default on the part of Visapoint.travel or indemnified persons, the liability shall be limited to the cost of the service the client has procured from Visapoint.travel.The client hereby acknowledges that the provisions of this section shall apply to the service.
Limitation of liability
Visapoint.travel accepts no liability for travellers electing to obtain on-arrival visas. To the maximum extent permitted by law, Visapoint.travel excludes or limits any direct, indirect or consequential loss and all statutory or implied conditions and warranties, including, without limitation, lost profits or travel or holiday costs or any loss arising from information obtained from the Website
General
These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any contract. If any provision of these Terms does not comply with any law, then the provision must be read down so as to give it as much effect as possible. If it is not possible to give the provision any effect at all, then it must be treated as severable from the rest of the Terms. Where Visapoint.travel is unable to carry out any obligation under the contract due to any circumstance, matter or thing beyond its reasonable control (“force majeure”) Visapoint.travel shall be excused from such obligations to the extent of such prevention, restriction or interference so caused. Visapoint.travel may sub-contract all or part of its obligations or assign all or part of its rights under this contract. This agreement does not create any right enforceable by a person who is not a party to it, except for any lawful successor or assignee. The laws of Nigeria shall govern any dispute arising under this agreement; both parties agree to submit to the exclusive jurisdiction of the courts of Nigeria.
